Direct answer
No. A landlord in Nigeria cannot lawfully lock a tenant out, remove the roof, disconnect power or water, throw out their belongings, or send people to make them leave, even if the tenant owes a year of rent and the notice has long expired. The only lawful route to possession runs through the court. This is one of the few points in Nigerian tenancy law with no real grey area, and it is still the one landlords break most often, usually because the lawful route feels slow. This guide explains why self-help backfires and what to do instead.
What counts as self-help
Self-help is any attempt to recover possession, or to pressure a tenant into leaving, without a court order. It does not have to involve force. Making the premises uninhabitable so the tenant gives up is self-help just as surely as changing the locks.
- Changing the locks or padlocking the gate while the tenant is out
- Removing doors, windows or roofing sheets
- Disconnecting electricity, water or the prepaid meter
- Removing or throwing out the tenant's belongings
- Sending thugs, area boys or omo onile to threaten or harass the tenant
- Repeated unannounced visits or disturbance designed to make occupation unbearable
- Using the police to remove a tenant without a court order
What the law says
In Lagos, the Tenancy Law of Lagos State 2011 makes specified conduct an offence: forcibly ejecting a tenant, threatening or molesting them to make them leave, and damaging the premises or carrying out alterations meant to force them out. The penalty is a fine of up to N250,000 or up to six months in prison, or a non-custodial disposition. The pending 2025 Bill would raise the penalties if it is assented to.
Outside the areas the Lagos Law covers, and in other states, the same conduct is still unlawful. It amounts to trespass and, depending on what was done, to criminal damage or assault. Nigerian courts have consistently held that a landlord who wants a tenant out must go through the legal process, however strong their underlying claim.
Note that the police have no power to evict a tenant without a court order. A tenancy dispute is a civil matter, and a landlord who involves the police to remove a tenant is exposing themselves, not the tenant.
What a locked-out tenant can claim
A tenant who is unlawfully evicted can go to court for an order restoring them to possession, and for damages for trespass and for any belongings lost or damaged. Where the conduct was high-handed, courts can award aggravated or exemplary damages on top.
The worst consequence for the landlord is usually not the damages. It is that the self-help undermines their own case. A landlord who was owed rent and had a valid notice can find themselves defending a trespass claim, paying the tenant's costs, and starting the recovery process again from the beginning, with the tenant back in occupation.
| Self-help | Lawful route | |
|---|---|---|
| Speed | Feels fast, often reversed | Slower, but final |
| Criminal exposure | Offence in Lagos; possible criminal damage elsewhere | None |
| Civil exposure | Trespass, damages, costs | None |
| Arrears recovered | Rarely, and the claim is weakened | Can be ordered with possession |
| Result | Tenant may be restored to possession | Enforceable order for possession |
The lawful route, in order
The lawful route is not as slow as most landlords assume, provided each step is done correctly the first time. Most delay comes from defective notices that have to be re-served, not from the court itself.
- Confirm the tenancy type and read the agreement for an agreed notice period
- Serve a valid notice to quit, unless a fixed term has simply expired
- After it expires, serve a written notice of intention to recover possession of at least seven days
- File the recovery action and claim arrears or mesne profits in the same proceedings
- Enforce the order for possession through the court's officers
Why landlords reach for self-help
Usually because they have lost track. A tenant has been behind for months, nobody served a notice at the right time, and the landlord realises that the lawful route now starts from zero. The temptation to cut the corner is strongest when the paperwork was never started.
The fix is upstream. A landlord who knows the day a tenant falls behind, sends reminders, and serves notice promptly when it is warranted rarely gets to the point where self-help looks attractive. We covered the escalation sequence in our guide to handling rent defaults.
How Ledge helps you stay on the lawful route
Ledge shows who is behind and by how much, so arrears are visible early rather than discovered at the end of the year. Every payment is recorded with a date and a receipt, so the arrears figure you put before a court is a statement, not an estimate.
When a tenancy needs to end, Ledge drafts the notice with the parties and premises filled in from the tenancy record and keeps a record of what was served and when. You set the expiry date after checking the tenancy type and the agreement; Ledge does not work out the notice period for you.
None of this is legal advice. If a tenant has already been locked out, or you are being accused of it, speak to a lawyer now.
Frequently asked questions
Can a landlord change the locks if the tenant has not paid rent in Nigeria?
No. Non-payment does not give the landlord a right to lock the tenant out. Possession must be recovered through a valid notice, a notice of intention to recover possession, and a court order. In Lagos, forcibly ejecting a tenant is an offence under the 2011 Law.
What is the penalty for illegal eviction in Lagos?
Under the Tenancy Law of Lagos State 2011, forcible ejection, threats or molestation to make a tenant leave, and damage meant to force them out carry a fine of up to N250,000 or up to six months in prison. The landlord may also face a civil claim for trespass and damages.
Can the police evict a tenant in Nigeria?
Not without a court order. A tenancy dispute is a civil matter. Possession orders are enforced by the court's own officers.
Can a landlord disconnect electricity to force a tenant out?
No. Cutting off power or water to make a tenant leave is self-help. In Lagos it can fall within the offences under the 2011 Law, and anywhere in Nigeria it exposes the landlord to a claim for damages.
