The guide

Serving a notice to quit in Nigeria

General information, not legal advice. Where a tenancy is in dispute, speak to a lawyer before you serve or sign anything.

  1. Check whether the Lagos law applies first

The Tenancy Law of Lagos State 2011 does not cover the whole of Lagos. It excludes Apapa, Ikeja GRA, Ikoyi and Victoria Island, and certain institutional accommodation. Excluded premises still need a lawful recovery process, so check which rules govern your tenancy before you serve anything.

  2. The notice period is yours to check

This generator puts the notice in the proper form. It does not work out the notice period: you set the date the tenant must give up possession.

Under the 2011 Law the default periods depend on the tenancy type, and they apply where the tenancy agreement says nothing about notice. Where the parties agreed a notice period in writing, that agreed period generally governs instead. Read the agreement before you count days.

    • Tenant at will: 1 week
    • Monthly tenant: 1 month
    • Quarterly and half-yearly tenants: 3 months
    • Yearly tenant: 6 months
  3. The second notice people forget

Where the tenant does not give up possession after the notice to quit expires, the landlord serves a further written notice of intention to recover possession, giving not less than seven days and stating the grounds and particulars of the claim. Only after that does the landlord go to court.

No notice, on its own, authorises an eviction. The 2011 Law makes forcible ejection, threats or molestation to make a tenant leave, and damage or alterations meant to force them out, offences.

Questions

How much notice must a landlord give in Lagos?

Where the tenancy agreement says nothing about notice, the 2011 Law sets defaults by tenancy type: one week for a tenant at will, one month for a monthly tenant, three months for quarterly and half-yearly tenants, and six months for a yearly tenant. An agreed written notice period generally governs instead.

Does this tool calculate the notice period for me?

No. You set the date the tenant must give up possession. Check it against the tenancy type and the tenancy agreement before you serve the notice.

Can I evict a tenant once the notice to quit expires?

Not on your own. A seven-day notice of intention to recover possession follows, and possession is then a matter for the court.
